VO2MAX — Terms of Use

These Terms of Use ("Terms") govern your use of the VO2MAX services, including running plans, VO₂ Pro, accounts, and related support (the "Service"). In these Terms, "VO2MAX", "we", "us", and "our" refer to the Service provider. By creating an account or using the Service, you agree to these Terms and acknowledge the Medical Disclaimer.

The license for the VO2MAX iPhone and Apple Watch applications is governed by Apple’s standard Licensed Application End User License Agreement (EULA). These Terms supplement that EULA for the Service; they are not a separate app license agreement.

1. The Service

VO2MAX provides running plans, Apple Watch workout guidance, heart-rate-zone information, workout analysis, progress information, reminders, calendar synchronization, and optional adaptive recommendations.

The Service is a fitness and wellness tool. It is not a medical device, healthcare provider, diagnosis, treatment, or emergency service. It does not guarantee a particular VO₂ max, race time, fitness result, or absence of injury.

2. Eligibility and optional account

You must be at least 13 years old and legally permitted to use the Service. You can use VO2MAX with a local profile without creating an account, or optionally register with Sign in with Apple. If you register, you are responsible for keeping access to your Apple account secure. Provide accurate information and do not access another person's account.

A local profile is stored on your iPhone and paired Apple Watch. It is not a cloud backup and may be lost if you clear the local profile, erase or replace the device, or delete the App. You may later register with Sign in with Apple without replacing the local plan currently on that device.

Registered users may sign out from the Profile screen or permanently delete their account from Profile → Settings → Account → Delete Account. Local-profile users may remove their local app data from Profile → Settings → Account → Clear Local Data and Exit. If you cannot access a registered account, request deletion at let.me.mvp.it@gmail.com. Deleting an account or clearing a local profile does not automatically cancel an active App Store subscription; subscriptions must be managed or cancelled in your Apple account settings. We may restrict access where reasonably necessary for security, misuse, or legal compliance.

3. Safe use

You are responsible for deciding whether a workout is appropriate for you and for using the Service safely. Consult a qualified healthcare professional before starting or changing an exercise program, especially if you have a medical condition, are pregnant, take medication, have been inactive, or have been advised to restrict exercise.

Stop exercising and seek immediate medical assistance for chest pain, fainting, severe dizziness, unusual shortness of breath, or other serious symptoms. Do not rely on the Service to identify or respond to an emergency.

4. Apple Health and third-party services

Apple Health, Apple Watch, Calendar, notifications, Sign in with Apple, and the App Store are optional or third-party services governed by their own terms and policies. You are responsible for granting and managing permissions for integrations you enable.

Heart-rate zones, VO₂ max estimates, recovery signals, and other measurements may be delayed, incomplete, unavailable, or inaccurate. Use them as informational guidance, not professional advice.

5. VO₂ Pro subscriptions

The base plan generated during onboarding is available without a paid subscription. Adaptive plan changes, detailed adaptive feedback, rescheduling, and plan customization may require VO₂ Pro.

VO₂ Pro is offered through Apple's App Store as an auto-renewing subscription. The current options are:

• VO₂ Pro Monthly: US$6.99 per month;
• VO₂ Pro Annual: US$44.99 per year; and
• Trial: 14 days when displayed as available in the App Store purchase sheet.

Actual price, currency, taxes, eligibility, and trial availability are shown by Apple before purchase and may vary by storefront. A trial converts to the selected paid subscription unless cancelled at least 24 hours before it ends. Subscriptions renew automatically unless cancelled at least 24 hours before the current period ends. You can manage or cancel a subscription in your Apple account settings. Apple handles billing and refunds under its applicable terms and mandatory law.

6. Acceptable use

You must not:

• use the Service unlawfully, fraudulently, or to harm another person;
• submit another person's sensitive information without permission and a lawful basis;
• scrape, probe, overload, disrupt, reverse engineer, or bypass security or subscription controls except where a restriction is prohibited by law;
• use the Service for medical, employment, insurance, emergency, or other high-stakes professional decisions; or
• copy, resell, sublicense, or redistribute the Service or its content except as permitted by law.

7. Intellectual property

The Service, including its software, design, names, graphics, interfaces, text, and training content, belongs to us or our licensors and is protected by applicable intellectual-property laws. Your license to use the VO2MAX applications is provided under Apple's standard EULA. These Terms do not grant a separate license to the applications or any rights beyond those required to use the Service as permitted by that EULA.

8. Availability and changes

The Service may be unavailable, delayed, changed, or discontinued because of maintenance, updates, provider failures, security incidents, legal requirements, or events outside our reasonable control. We do not promise continuous or error-free availability.

We may update these Terms when the Service, purchases, providers, or applicable law changes. Material changes apply prospectively after any notice or consent required by law.

9. Disclaimers and liability

To the maximum extent permitted by law, the Service is provided "as is" and "as available" without a promise that it is uninterrupted, secure, accurate, complete, or suitable for every person or workout.

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages or for loss of profits, opportunities, goodwill, or data arising from the Service. Nothing in these Terms excludes mandatory consumer rights, statutory warranties, or liability that cannot lawfully be excluded or limited.

10. Governing law

These Terms are governed by the laws of Georgia, except that mandatory consumer-protection, privacy, and digital-content laws of your country may apply regardless of that choice. Disputes may be brought before the courts of Georgia, subject to any mandatory right to bring a claim elsewhere.

11. Apple terms and the standard EULA

Apple's standard EULA governs the license for the VO2MAX applications. If these Terms conflict with that EULA on the application license, the EULA controls to the extent of the conflict. Apple has no obligation to provide maintenance or support for VO2MAX. We, not Apple, are responsible for the Service and for addressing claims relating to it to the extent required by law. Apple and its subsidiaries are intended third-party beneficiaries of the provisions relating to the App Store license and may enforce it where permitted.
